Terms and Agreements
PLEASE READ VERY CAREFULLY!
1. Pre-Commencement Arrangements
Before any work begins, it is essential that both the customer and S1 Builders Norfolk agree on all access arrangements. This includes details for mixing areas, toilets, water supply, electricity, and storage of materials, both for use during the day and, where feasible, overnight.
2. Quotation Purpose and Customer Responsibilities
The purpose of providing a quotation is to enable the customer to fully understand the scope of works that S1 Builders Norfolk will undertake, along with the associated costs. It is the customer’s sole responsibility to highlight any missing, incorrect, extra, or misunderstood works, materials, or terminology to S1 before agreeing to the quotation. Once signed, any changes made by the customer to the quotation remain their responsibility. The customer may not raise issues about missing or misunderstood works after works have commenced. S1 Builders Norfolk will only be responsible for the works set out in the quotation. Any additional works must be agreed in writing by both parties.
3. Regulatory and Planning Compliance
Any changes to rules relating to building control, planning, architects, or similar regulations are beyond the control of S1 Builders Norfolk and are solely the client’s responsibility.
4. Project Timings
The agreed start and finish times for the project will be set by both parties but may be subject to change.
5. Quotation as an Agreement
The quotation acts as an agreement between S1 Builders Norfolk and the customer, defining the scope of works. Any amendments to the quotation will be treated as revisions and costed accordingly.
6. Payments and Payment Structure
Full payment for any special materials must be received by S1 Builders Norfolk before they are ordered. The preferred method of payment is BACS. All quotations are subject to VAT at the prevailing rate of 20%. Structured payments are required, typically 40% on day one, 30% at the midway point, and 30% upon completion and sign-off. All payments must be made upon receipt of the invoice.
If the client is unable to sign the works off on the day of completion, 50% of the final payment is due immediately, with five working days allowed for sign off and the remaining payment. If the client cannot adhere to these terms, full payment will be required until the client can visit the site and sign off. No alternative credit or payment terms are offered.
7. Information and Material Supply
If the customer supplies information or materials to S1 Builders Norfolk, or requests S1 to obtain them, the customer is solely responsible for the accuracy of the supplied items. Errors may result in complications or fluctuations in price.
8. Additional Works (“Extras”)
Extras are treated as separate jobs and must be paid for upon completion of the extra work, not at the end of the main project. Stage payments for extras must be agreed and set out in writing before work commences.
9. Insurance and Site Safety
S1 Builders Norfolk is covered by public liability insurance to the value of £2 million. During the works, the site will be considered a building site, and S1 Builders Norfolk is responsible for maintaining a safe environment. Where it is not possible to guarantee complete safety, S1 will ensure the area is left in a safe condition and will make the customer aware of any potential hazards.
10. Building Control and Professional Liaison
The customer is responsible for dealing with building control unless S1 Builders Norfolk has agreed to undertake this process, in which case any charges incurred will be the client’s responsibility. S1 Builders Norfolk can liaise with building control, architects, structural engineers, or planning professionals if required, but all professional fees must be paid directly by the client.
11. Company Enquiries and Staff Conduct
All enquiries should be directed through Mr. Nicholls. S1 Builders Norfolk staff will not undertake any work outside of the company.
12. Loss, Damage, and Liability
The client is responsible for any damage, loss, or theft of works during and after completion if the works are in their care. S1 Builders Norfolk reserves the right to seek legal advice or to admit liability if the customer has acted negligently, following advice given verbally or in writing.
13. Advice and Guarantees
All advice is provided to the best of S1 Builders Norfolk’s knowledge. The customer is solely responsible for accepting or disregarding such advice. All quoted works are guaranteed to be carried out professionally. Manufacturer guarantees apply in accordance with their guidelines, particularly for specialist materials, which must be paid for in advance.
14. Ownership of Materials
All materials remain the property of S1 Builders Norfolk until they have received full payment. Any excess materials not used in the works will be returned, sold, recycled, or stored for future use by S1 Builders Norfolk.
15. Agreement and Additional Works
Works will only be undertaken if the customer signs and returns the quotation. Any additional works that may arise will require a separate agreement unless alternative arrangements are made.
16. Client Responsibilities for Site Conditions
The client is responsible for managing any settlement, drying, or shrinkage cracks that may appear if the heating is turned up and the works dry out too quickly.
17. Scope of Works and Site Preparation
S1 Builders Norfolk will provide and install barriers and floor coverings as necessary for the project. Ladders and scaffolding will also be supplied as required. The team will clear the site of waste materials and dispose of them properly. A builder’s clean will be performed on all relevant areas after completion, but clients may wish to arrange a deep clean with another provider.
18. Quotation Matching and Quality Assurance
Where possible, S1 Builders Norfolk will strive to match like-for-like quotations from other providers without compromising on material or workmanship quality.
19. Material Supply by Client
If clients decide to supply their own materials, they are responsible for ensuring that those materials are adequate and of suitable quality. S1 Builders Norfolk cannot be held liable for failures or shortfalls in client-supplied materials.
20. Unforeseen Works
Any unforeseen works not included in the original quotation will be considered as extras and will incur additional charges.
21. Understanding and Acceptance
It is the client’s responsibility to read, understand, and seek clarification on any aspect of the quotation. Only the works detailed in the quotation will be undertaken for the agreed amount. Any additional or non-listed works will incur extra charges. Agreement to the details below confirms that the client understands and accepts these terms. If an item is not listed, it is not included; clients should consult S1 Builders Norfolk for clarification if required.
22. Errors and Omissions Excepted (E&OE)
All terms and details are subject to errors and omissions excepted.
